How will the Declaration of Independence

 In view that the popular consultation referendum that seeks to promote the Generalitat of Catalonia with permission of Madrid is pray, and then not take place because the Kingdom of Spain is not exactly a democratic country, we should start thinking and practice the famous "Plan B", the Declaration of Independence, if we really want to get to the Catalan state and the state of Massachusetts or the Ithaca of Homer.

    Declarations of Independence part of most processes of national liberation, and are accepted by international law, supervised by the UN (judgment of 13 July 2010 the International Court of The Hague). In fact, they are a tool, and can be developed in different ways, allowing proclamations type: presidential, parliamentary / assembly-or municipal. For Catalan, although parliament is the right formula, we see that we serve other systems in order to proclaim the Catalonia state, and was recognized by other states in the world.

     The presidential proclamation is that which makes a people democratically elected president, with the power to guarantee the legal and political support that are available. In our case, if both the president Artur Mas, the CEO would like to qualify for a majority of the Catalan Parliament, representing the people as well. Despite being a proper way, it is unusual, and it is best to reserve it for emergency situations, for example in case intervention autonomy by Spain, in order to appeal the international protection due to human rights abuses.

 

      The Declaration is the most common parliamentary Declarations. It's unilateral decision to create a new state for a parliament, courts or other territorial body by a majority of the House who supports and votes for it. On a practical level is different formalities: an Act of Declaration of Independence itself, an informal statement of Members-at-Montenegro style, or the adoption of a constitution for the new state to abrogate the Constitution and / or laws of the former state-which was part. It is good to remember that in 2010 the Catalan Solidarity (SI) was presented with the elections law Declaration of Independence, which in 2011 entered Parliament plenary session and approved or processed following the CiU opposition and similarly Rally 2010 also introduced a Constitution Catalan elections, which could not materialize. Three years after those programs enviable independence, the current ruling majority have not advanced much nothing beyond opportunistic rhetoric and lyrical passages about the desert.

     Before reaching the last formula, we make a point to the part and proclaimed Assembly. Another alternative would be to beat Spain if our bodies could intervene. Because we would not Parliament, should be an assembly of representatives of the people, that those members would remain / were chosen since the last election.

    From the Assembly, a majority could proclaim the Catalan State. (We believe it will not come back and we went after the last Civil War, when Republican members in exile created a Catalan Council to keep the project in the Republic and its institutions.)

     The formula is a municipal resource to be exploited in that extreme case of countries that have no executive or legislative body itself and its power based only in municipalities that comprise it. International law also recognize Independence proclaimed by a majority of municipalities will coordinate and recognize the freedom and self-determination of its people.

     Finally, a little reflection: it will remain independent for both the negative and the Spanish opposition, but by inaction caste political autonomy, which takes too long apoltronada in salaries and positions us and giving us excuses and creating uncertainty .
